Welcome to Posttar.com (“Posttar”, “we”, “our”). These Terms of Use govern the access and use of our online platform available at https://app.posttar.com, as well as services, integrations, APIs and any application provided by Posttar (collectively, “Services”).
By accessing or using Posttar, you (“User”, “you”, “your”) declare that you have read, understood and agree to these Terms of Use and our Privacy Policy.
If you do not agree, you should not use the Services.
1. Scope of Services
Posttar offers a SaaS (Software as a Service) platform that enables the User to:
- Import, view, organize and manage social media content in a centralized interface;
- Analyze content performance metrics and insights;
- Create, adapt and edit social media content, including with AI assistance;
- Connect social media accounts via official APIs or authorized integrations;
- Publish, schedule and manage posts on compatible networks;
- Define and maintain brand identity (Brand DNA) to guide content production;
- Collaborate as a team in managing content for one or more projects.
Currently supported networks include Instagram. Integrations with other platforms (such as LinkedIn, Threads, TikTok and YouTube) may be added in the future, subject to the policies and availability of the respective external platforms.
Posttar reserves the right to modify, suspend or discontinue Service features at any time, with reasonable prior notice when possible.
2. User Account
To use the Services, the User must:
- Create an account with truthful and up-to-date information;
- Keep credentials secure and not share them;
- Be exclusively responsible for all activity under their account.
It is prohibited to:
- Create automated, fake or impersonated accounts;
- Share access with third parties without specific authorization from the team feature;
- Use the platform for illicit, unethical purposes or that violate third-party rights;
- Attempt to access restricted areas, circumvent security mechanisms or reverse engineer the system.
If unauthorized use is identified, the User must immediately notify Posttar at contato@posttar.com.
3. Connection with Third-Party Platforms
When connecting social networks, the User:
- Authorizes Posttar to access data permitted by the official APIs of the respective platforms;
- Agrees to the terms and policies of the connected platforms;
- Is responsible for maintaining valid access (tokens, permissions, etc.);
- Acknowledges that Posttar stores access tokens in encrypted form solely to maintain the integration.
Posttar is not affiliated with Instagram, Meta, Google, YouTube, LinkedIn, TikTok or any other third-party platform, and does not guarantee:
- Continuous availability of integrations;
- Successful delivery of publications due to external failures;
- Maintenance of features dependent on third parties;
- That changes in APIs or policies of third-party platforms will not affect feature availability.
4. Content Responsibility
The User is exclusively responsible for:
- Content generated, uploaded, published or manipulated via Posttar;
- Ensuring they have rights to the material used;
- Complying with applicable legislation and copyright laws;
- AI-generated content, which the User must review and approve before publishing.
It is expressly prohibited to use Posttar for content that:
- Violates intellectual property rights;
- Is defamatory, discriminatory, offensive or illegal;
- Is pornographic or aimed at minors;
- Promotes hate, extremism, violence or misinformation;
- Is spam, phishing or any form of malicious content;
- Violates the policies of connected social media platforms.
4.1. Specific Content Restrictions (Brazilian Law)
Without prejudice to the above, it is strictly prohibited to use Posttar to create, store, distribute, publish or promote content that constitutes or encourages:
- Antidemocratic conduct and acts as defined in articles 286 (sole paragraph), 359-L, 359-M, 359-N, 359-P and 359-R of the Brazilian Penal Code;
- Terrorism or preparatory acts of terrorism, as defined by Law No. 13,260/2016;
- Inducement, instigation or assistance to suicide or self-harm, pursuant to article 122 of the Brazilian Penal Code;
- Incitement to discrimination based on race, color, ethnicity, religion, national origin, sexuality or gender identity (including homophobic and transphobic conduct), under articles 20, 20-A, 20-B and 20-C of Law No. 7,716/1989;
- Crimes against women based on gender, including content that propagates hatred against women, under Law No. 11,340/06, Law No. 10,446/02, Law No. 14,192/21 and related provisions of the Brazilian Penal Code;
- Sexual crimes against vulnerable persons, child pornography and serious crimes against children and adolescents, under articles 217-A, 218, 218-A, 218-B and 218-C of the Brazilian Penal Code and articles 240, 241-A, 241-C and 241-D of the Child and Adolescent Statute;
- Human trafficking, pursuant to article 149-A of the Brazilian Penal Code.
Identification of any content falling under these categories may result in immediate removal of the content, suspension or termination of the User's account, and reporting to the competent authorities, as provided by applicable law.
5. Use of Artificial Intelligence
Posttar may use AI models to assist in creating, adapting and suggesting content. By using these features, the User acknowledges and agrees that:
- AI-generated content is provided as suggestions and must be reviewed before publishing;
- Posttar does not guarantee the accuracy, originality or suitability of AI-generated content;
- The User is ultimately responsible for all published content, regardless of AI involvement;
- User data used for AI content generation is processed according to our Privacy Policy;
- Data obtained via third-party platform APIs (Google, Instagram) is not used for AI model training.
6. Plans, Payments and Renewals
Posttar offers free and paid plans. When subscribing to a plan:
- The User agrees to the prices, billing frequency and recurring charges;
- Applicable taxes may be added;
- Renewal is automatic until cancelled by the User;
- Cancellation does not generate a proportional refund, unless required by law;
- Access to paid features will be maintained until the end of the already-paid period.
Payments are processed by authorized third parties (such as Stripe).
Posttar may change prices or features at any time with reasonable prior notice. Price changes will not affect already-paid periods.
7. Usage Limits and Quotas
Plans may include limits on: connected accounts, publications, scheduling, API requests, team members, projects and workspaces.
Posttar may suspend use that exceeds contracted limits, constitutes abuse, circumvents protection mechanisms, or compromises platform stability for other users.
8. Intellectual Property
All software, name, brand, design, interface, technologies, models, workflows, algorithms, prompts, templates and materials belong exclusively to Posttar. These Terms grant no rights beyond limited platform use during the account's active period.
The User retains ownership of their own content. By using the Services, the User grants Posttar a limited, non-exclusive, revocable license to process, store and display their content solely for providing the Services.
9. Privacy and Data
Data collection, processing and sharing follow Posttar's Privacy Policy and applicable legislation, including Brazil's LGPD.
10. Suspension and Cancellation
We may suspend or cancel accounts that violate these Terms, generate operational, technical or legal risks, use the service abusively, or remain inactive for extended periods (free plans). Severe violations may result in immediate removal without prior notice.
The User may request account cancellation at any time through the platform settings or via email.
11. Warranties and Disclaimer
Posttar is provided “as is” and “as available”. We do not guarantee error-free or uninterrupted service, financial or engagement results, continued compliance with third-party API changes, or accuracy of AI-generated content.
Posttar is not liable for: reputation losses from User posts, content removal by connected platforms, external failures, data loss from User actions, credential misuse, or scheduled/emergency maintenance.
12. Limitation of Liability
To the maximum extent permitted by law, Posttar's total liability is limited to the amount actually paid by the User in the 12 months preceding the event. Posttar shall not be liable for indirect, incidental, special, consequential damages, lost profits or opportunities.
For free plan users, liability shall not exceed the equivalent of 1 month of the most basic paid plan at the time of the event.
13. Indemnification
The User agrees to indemnify and hold harmless Posttar, its directors, employees and partners from any claims, losses, damages, costs and expenses arising from: violation of these Terms, content published via the platform, violation of third-party rights, or credential misuse.
14. Changes to Terms
We may update these Terms with at least 15 days' prior notice via the platform or email. Continued use after changes implies full acceptance of the new version. If the User disagrees, they should stop using the Services.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be submitted to the courts of Porto Velho/RO, waiving any other jurisdiction. The parties agree to attempt amicable resolution before litigation.
16. General Provisions
- If any provision is invalid, the remaining provisions remain in full force.
- Failure to exercise any right does not constitute waiver.
- These Terms, together with the Privacy Policy, constitute the entire agreement between the User and Posttar.
